What personal information do we collect?
In order to be able to fulfil any contract with you, as well as to provide you with requested services such as quotes and advice, and for our legitimate business purposes, we need to collect your name, e-mail address, postal address and phone number. These are generally collected via a contact form on our website or from an e-mail you send us.
We may also need your date of birth, passport information, details of next of kin/an emergency contact and medical information. These are only collected at the time of booking when you enter into a contract with us or shortly before your holiday or course commences.
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.
If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
Embedded content from other websites
Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.
We use standard Google Analytics to track website usage. This data is anonymized by Google and we are unable to identify individual users by this means.
How do we use your information?
Your name and contact details will be used for contractual purposes e.g. invoicing, crew lists etc. and logistical purposes such as letting you know of short-notice changes to venues and times of holidays or courses.
Passport information will only be used where required by the authorities.
We, our instructors and our skippers need information about any medical issues you may have in order a) to advise you of the suitability of the holiday or course you are interested in, b) to ensure the safety of you and other people on your holiday or course as you and c) to ensure that you and your fellow students / holidaymakers enjoy and get the most out of your holiday or course.
If you are a client or have contacted us for a quote or with an enquiry, we will also add your name and e-mail address to our mailing list (legitimate interests). You can unsubscribe from the mailing list at any time.
If you have asked us to keep you informed about what we are doing, either by subscribing via our website or by voluntarily giving us your contact details in any other way, we will add your e-mail address to our mailing list so that we can send you newsletters, promotions, surveys and other information relating to Cloud Nine Sailing’s activities. If you also give us your name, we will also add this to our mailing list because you are a person, not just a subscriber. Again, you can unsubscribe at any time.
What is our legal basis for using your information?
In the vast majority of cases, we collect and retain your information because we are obliged to do so by law, regulations or our governing body, or in order to fulfil a contract with you or prepare for this. We may occasionally contact you for our legitimate commercial interest.
How long do we store your information?
Under Swiss law we are required to keep business records, which may include personal information such as name, contact details, contract and order information etc., for a minimum of ten years. Any records we are not required to keep either by law, regulations or our governing body will only be held for as long as we need it.
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
Where do we store your information?
For both operational and security reasons, any information we collect is stored either within our secure cloud-based accounting and CRM system in Switzerland (Bexio) or in other password-protected cloud services covered by the US Privacy Shield Framework (Trello, OneDrive) in compliance with GDPR.
With whom do we share your information?
We do not sell your personal information to third parties for their marketing purposes.
As we work with partner schools (Horizon Watersports, Seafarer Training and Jolly Parrot) and the Royal Yachting Association, under certain circumstances we are required to share your information with these bodies in order to fulfil our contract with you. Information shared may include your name, contact details, e-mail address, date of birth and medical information. The latter may also be shared with your instructor or skipper for your own safety, as well as that of other people, but will be treated in the strictest of confidence.
Under some circumstances we are required to provide your name, nationality, date of birth and passport information to the authorities for crew lists so that our boat papers are legal. We will share this information with our agent who will prepare the boat papers accordingly.
Other certificates for courses we offer are not registered online. On successful completion of such courses, your name, certificate number and date of issue will be stored for a minimum of seven years as required by the Royal Yachting Association. You may choose not to have your details stored, but in that case neither we, the school issuing the certificate nor the Royal Yachting Association will be able to replace or verify your certificate in the future.
Visitor comments may be checked through an automated spam detection service.
What rights do you have over your information?
You can request that we erase any personal data that we hold about you. This does not include any data we are obliged to keep for administrative, legal or security purposes. If you have left comments on this site, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
